General Terms and Conditions

Article 1 - Definitions

In these general terms and conditions the following terms are understood to mean:

• Dock 15: The trade name of KramerKraakman BV, located at [address]
• Customer: The natural or legal person who enters into an agreement with Dok15
• Customer portal: The secure online platform of dok15.nl
• New construction project: A construction project where Dok15 supplies floor coverings
• ProductsFloor coverings such as PVC, carpet, laminate and related products
• Services: Advice, configuration, supply and installation of floor coverings

Article 2 - Applicability

These general terms and conditions apply to all offers, quotations and agreements between Dok15 and the customer, unless the parties have expressly agreed otherwise in writing.

Any purchasing or other conditions of the customer shall not apply unless Dok15 has expressly accepted them in writing.

Article 3 - Offers and conclusion of agreements

All Dok15 offers are non-binding, unless otherwise stated. Offers are valid for 30 days, unless otherwise stated.

An agreement is concluded by:

• Signing of a quotation by both parties, or
• Order confirmation via the customer portal, followed by order confirmation from Dok15

Article 4 - Prices and payment

4.1 Pricing

All prices in the customer portal include VAT and final prices. Prices are subject to change without notice, but are finalized once an order is confirmed.

4.2 Payment terms

• Payment is made via the Buckaroo payment system
• Deposit: 50% upon order confirmation
• Final payment: Before delivery/installation
• Payment term: 14 days after invoice date
• If the payment term is exceeded, we are entitled to charge interest.

Article 5 - Delivery and execution

5.1 Delivery times

Delivery times stated are indicative and depend on the progress of the new construction project. Dok15 is not liable for delays beyond its control.

5.2 Delivery and installation

• Delivery takes place at the address of the new-build home
• Installation is carried out by certified professionals
• Client ensures accessibility of the home
• Site conditions must be suitable for installation

Article 6 - Customer portal and configuration

6.1 Access

Access to the customer portal is granted via a unique project code. This code is personal and may not be shared with third parties.

6.2 Product configuration

• Dok15 pre-configures your home layout with rooms and surfaces
• Customer selects products per room via the portal
• Changes are possible until order confirmation
• Dok15 reserves the right to refuse technically impossible configurations

Article 7 - Right of withdrawal

Given the customized nature of our products and services, and the fact that products are manufactured to the specifications of your new-build home, cancellation is excluded in accordance with Article 6:230p, paragraph 1(e) of the Dutch Civil Code.

Article 8 - Warranty and liability

8.1 Product warranty

• Factory warranty according to supplier (usually 2-10 years)
• Installation warranty: 2 years on craftsmanship
• Warranty is void in case of improper use or modifications by third parties.

8.2 Liability

Dok15's liability is limited to the amount paid by the insurance company in the relevant case. If, for whatever reason, no payment is made, liability is limited to the invoice amount.

Dok15 is not liable for indirect damage, consequential damage, lost profits or savings.

Article 9 - Stylist services

9.1 Make an appointment

Stylist appointments can be booked through the customer portal against payment of the agreed costs.

9.2 Cancellation

• Cancellation up to 48 hours before appointment: free of charge
• Cancellation within 48 hours: 50% of the costs
• No-show: 100% of the costs

Article 10 - Force Majeure

Dok15 is not obligated to fulfill any obligation if prevented from doing so due to force majeure. Force majeure is defined as any circumstance beyond Dok15's control that prevents it from fulfilling its obligations to the customer, in whole or in part.

Force majeure includes, but is not limited to: construction delays, delivery problems at suppliers, extreme weather conditions, and government measures.

Article 11 - Intellectual property

All intellectual property rights to the customer portal, configuration software, drawings, and documentation belong to Dok15 or its licensors. The customer only obtains usage rights for the intended purpose.

Article 12 - Data protection

For the processing of personal data, we refer to our privacy statementThis forms an integral part of these general terms and conditions.

Article 13 - Complaints

Complaints regarding the performance of the agreement must be submitted to Dok15 in writing and with reasons within a reasonable time, but no later than 14 days after delivery/installation.

Article 14 - Dispute Resolution

All agreements between Dok15 and the customer are exclusively governed by Dutch law.

All disputes arising from agreements to which these general terms and conditions apply will be settled by the competent court in the district where Dok15 is established.

Article 15 - Changes to terms and conditions

Dok15 reserves the right to amend these terms and conditions. Amendments will take effect 30 days after publication on the website.

In the event of material changes that are detrimental to the customer, existing customers have the right to cancel the agreement within 30 days of notification.

Article 16 - Nullity or voidability

If one or more provisions of these terms and conditions are found to be void or voidable, the remaining provisions will remain in full force and effect. Any void or voidable provisions will be replaced by valid provisions that approximate the original provision as closely as possible.

Article 17 - Specific provisions for new construction projects

17.1 Project-dependent delivery

Delivery and installation depend on the progress of the new construction project. Dok15 coordinates the schedule with the main contractor and project developer.

17.2 Technical adjustments

If during construction it appears that adjustments are necessary due to technical circumstances, Dok15 will resolve this in consultation with the customer without additional costs, provided that this is within reasonable limits.

17.3 Delivery

Delivery will take place simultaneously with or shortly after the new-build home is completed. A delivery protocol will be drawn up and signed by both parties.

Article 18 - Final provisions

These terms and conditions are written in Dutch. If these terms and conditions are made available in other languages, the Dutch text will prevail in the event of any differences in interpretation.
